AGRICULTURAL AND VETERINARY CHEMICALS (CONTROL OF USE) AMENDMENT (BAN 1080) BILL 2002 (Brought in by Margaret Ann Putt) A BILL For an Act to amend the Agricultural and Veterinary Chemicals (Control of Use) Act 1995 by making it unlawful to poison or attempt to poison any native fauna using sodium fluoroacetate, also known as compound 1080. Be it enacted by his Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows: Short title 1. This Act may be cited as the Agricultural and Veterinary Chemicals (Control of Use) Amendment (Ban 1080) Act 2002. Commencement 2. This Act commences on a day to be proclaimed. Principal Act 3. In this Act, the Agricultural and Veterinary Chemicals (Control of Use) Act 1995 is referred to as the Principal Act. No. 106 of 1995 3

 


 

Section 18 amended (Offences involving use, &c., of chemical products) 4. Section 18 of the Principle Act is amended by inserting after subsection (3) the following subsections: (4A) Notwithstanding any other provision in this Act, a person, including an employee of the federal, state or municipal government, must not use, deal with, or have in a person's possession or custody a chemical product from the monofluoroacetate group. Penalty: Fine not exceeding 200 penalty units. (4B) Subsection (4A) excludes persons directly employed with the Fox Task Force, up until the period ending 1 October 2005. 4
