ABORIGINAL LANDS AMENDMENT BILL 2012 This Public Bill originated in the House of Assembly, and, having this day passed, is now ready for presentation to the Legislative Council for its concurrence. P. R. ALCOCK, Clerk of the House 21 June 2012 (Brought in by the Minister for Aboriginal Affairs, the Honourable Cassandra Stanwell O'Connor) A BILL FOR An Act to amend the Aboriginal Lands Act 1995 Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows: 1. Short title This Act may be cited as the Aboriginal Lands Amendment Act 2012. 2. Commencement This Act commences on the day on which this Act receives the Royal Assent. [Bill 27] 3

 


 

Aboriginal Lands Amendment Act 2012 Act No. of s. 3 3. Principal Act In this Act, the Aboriginal Lands Act 1995* is referred to as the Principal Act. 4. Section 27 amended (Land vested in Council) Section 27 of the Principal Act is amended by inserting after subsection (8B) the following subsections: (8C) There is reserved to the public during daylight hours, in relation to the land referred to in item 16 of Schedule 3, a right of pedestrian access over - (a) the Access Road to Lighthouse between the points marked A and B on Plan 9466 in the Central Plan Register except when a significant Aboriginal cultural event is being held on that land; and (b) a strip of land extending 15 metres from and above high- water mark as specified on that Plan. (8D) There is reserved to the public at all times, in relation to the land referred to in item 16 of Schedule 3, a right of vehicular access and pedestrian access over the hatched area of land bounded by *No. 98 of 1995 4

 


 

Aboriginal Lands Amendment Act 2012 Act No. of s. 5 lines A-C-D-E-F-A on Plan 9466 in the Central Plan Register. 5. Schedule 3 amended (Land Vested in the Council) Schedule 3 to the Principal Act is amended by inserting after 15 Clarke Island 5135 the following items: 16. Eddystone Point Lighthouse 9466 Historic Site 17. Rebecca Creek 9469 6. Repeal of Act This Act is repealed on the ninetieth day from the day on which it commences. Government Printer, Tasmania 5
