BIOLOGICAL CONTROL AMENDMENT BILL 2016 This Public Bill originated in the House of Assembly, and, having this day passed, is now ready for presentation to the Legislative Council for its concurrence. SHANE DONNELLY, Clerk of the House 25 October 2016 (Brought in by the Minister for Primary Industries and Water, the Honourable Jeremy Page Rockliff) A BILL FOR An Act to amend the Biological Control Act 1986 Be it enacted by Her Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows: 1. Short title This Act may be cited as the Biological Control Amendment Act 2016. 2. Commencement This Act commences on the day on which this Act receives the Royal Assent. [Bill 60] 3

 


 

Biological Control Amendment Act 2016 Act No. of s. 3 3. Principal Act In this Act, the Biological Control Act 1986* is referred to as the Principal Act. 4. Section 3 amended (Interpretation) Section 3(1) of the Principal Act is amended as follows: (a) by omitting "organisms," from the definition of kind and substituting "organisms, or viruses or sub-viral agents,"; (b) by omitting "paragraph (a);" from paragraph (b) of the definition of organism and substituting "paragraph (a); or"; (c) by inserting the following paragraph after paragraph (b) in the definition of organism: (c) a virus or sub-viral agent; (d) by omitting the definition of prescribed live organisms and substituting the following definition: prescribed organisms means organisms that are - (a) live organisms; or *No. 33 of 1986 4

 


 

Biological Control Amendment Act 2016 Act No. of s. 5 (b) viruses or sub-viral agents; 5. Section 4 amended (Biological control) Section 4 of the Principal Act is amended by omitting "live" and substituting "prescribed". 6. Section 19 amended (Agent organisms) Section 19(1) of the Principal Act is amended by omitting "live". 7. Section 20 amended (Agent application) Section 20(1) of the Principal Act is amended by omitting "live". 8. Section 24 amended (Notice of proposed agent organisms) Section 24(1) of the Principal Act is amended by omitting "live". 9. Section 28 amended (Emergency declarations) Section 28(1)(b) of the Principal Act is amended by omitting "live". 10. Section 29 amended (Declarations of existing released organisms) Section 29(1)(a) of the Principal Act is amended by omitting "live". 5

 


 

Biological Control Amendment Act 2016 Act No. of s. 11 11. Section 32 amended (Declaration of organisms declared under a relevant law) Section 32(2)(a) of the Principal Act is amended by omitting "live". 12. Section 35 amended (No legal proceedings to be instituted in respect of release of agent organisms under a relevant law) Section 35(3) of the Principal Act is amended by omitting "live". 13. Repeal of Act This Act is repealed on the three hundred and sixty fifth day from the day on which it commences. 6 Government Printer, Tasmania
