BIRTHS DEATHS AND MARRIAGES REGISTRATION (NO FORCED DIVORCE) AMENDMENT BILL 2014 (Brought in by Nicholas James McKim) A BILL FOR An Act to amend the Births Deaths and Marriages Registration Act 1999 to remove the discriminatory provision for forced divorce in the case of transgender Tasmanians. Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows: 1. Short title This Act may be cited as the Births Deaths and Marriages Registration Act (No Forced Divorce) Amendment Act 2014 2. Commencement This Act commences on the day after the day on which it receives Royal Assent. 3. Principal Act In this Act, the Births Deaths and Marriages Registration Act* is referred to as the Principal Act. 4. Section 28A amended (Application to register change of sex) Section 28A of the Principal Act is amended as follows: (b) by omitting from subsection (1) (b) "and"; (c) by omitting from subsection (1) (c) "who is not married". 5. Section 28C amended (Registration of change of sex) Section 28C of the Principal Act is amended as follows: By omitting from subsection (3) "The Registrar must not note in the Register particulars of the change of a person's sex if the person is married". 6. Repeal of Act This Act is repealed on the three hundred and sixty fifth day on which it commences. *No. 58 of 1999
