FORESTRY AMENDMENT BILL 2002 (Brought in by the Minister for Economic Development, Energy and Resources, the Honourable Paul Anthony Lennon) A BILL FOR An Act to amend the Forestry Act 1920 Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows: Short title 1. This Act may be cited as the Forestry Amendment Act 2002. Commencement 2. This Act commences on the day on which the Government Business Enterprises Amendment Act 2002 commences. Principal Act 3. In this Act, the Forestry Act 1920* is referred to as the Principal Act. *No. 60 of 1920 [Bill 83] 3

 


 

s. 4 No. Forestry Amendment 2002 Section 12M amended (Chief executive officer) 4. Section 12M of the Principal Act is amended by omitting subsections (2) and (3) and substituting the following subsection: (2) The Board must not appoint the chairperson as chief executive officer. Schedule 2 amended (Directors) 5. Schedule 2 to the Principal Act is amended as follows: (a) by omitting from clause 1(1) "5 years" and substituting "3 years"; (b) by omitting subclauses (2) and (3) from clause 1 and substituting the following subclauses: (2) A director who is also the chief executive officer holds the office of director while he or she is the chief executive officer. (3) A person is not eligible to be appointed as a director if the person has attained the age of 72 years. (4) If a director held office as director immediately before the commencement of the Forestry Amendment Act 2002 and his or her instrument of appointment provided for a term of office exceeding 3 years - (a) subclause (1) does not apply in respect of that term of office; and (b) the director is entitled to complete that term of office as if that subclause had not been amended by that Act. 4

 


 

2002 Forestry Amendment No. s. 5 (c) by omitting paragraph (b) from clause 7(1) and substituting the following paragraph: (b) the director fails to disclose a material personal interest as required under the Government Business Enterprises Act 1995; or Government Printer, Tasmania 5
