FREEDOM OF INFORMATION (RELEASE PROVISIONS EXPANDED) BILL 2004 (Brought in by Nicholas James McKim) A Bill for An Act to amend the Freedom of Information Act 1991 to update the Act by the removal of the exemptions for the Civil Construction Corporation, Private Forests Tasmania and Forestry Tasmania, and to restore the ability of the Ombudsman to release information previously considered exempt. Be it enacted by his Excellency the Governor of Tasmania, by and with their advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows: Short Title 1. This Act may be cited as the Freedom Of Information (Release Provisions Expanded) Act 2004. Commencement 2. This Act commences on the day on which it is proclaimed. Principal Act 3. In this Act, the Freedom of Information Act 1991 is referred to as the Principal Act.

 


 

Section 32A Deleted 4. Delete following Section 32A. Section 48 (5) amended 5. Section 48 (5) of the Principal Act is amended by the deletion of all words after `includes the power to' and the insertion of: (a) to reconsider the application as if it were an original application; (b) to decide that exempt information should be provided; and (c) to provide exempt information.
