A BILL FOR
An Act to amend the Crown Lands Act 1976, the Forest
Management Act 2013, the Forestry (Rebuilding the Forest
Industry) Act 2014, the Nature Conservation Act 2002and
the Forest Practices Regulations 2007
Be it enacted by Her Excellency the Governor of Tasmania, by
and with the advice and consent of the Legislative Council and
House of Assembly, in Parliament assembled, as follows:
PART 1 - PRELIMINARY
1. Short title
This Act may be cited as the Forestry
(Unlocking Production Forests) Act 2017.
2. Commencement
(1) Except as provided by subsection (2), this Act
commences on the day on which this Act
receives the Royal Assent.

PART 2 - CROWN LANDS ACT 1976 AMENDED
3. Principal Act
In this Part, the Crown Lands Act 1976* is
referred to as the Principal Act.
4. Section 29 amended (Lease of Crown land)
Section 29 of the Principal Act is amended by
omitting subsection (3) and substituting the
following subsection:
(3) Despite the provisions of subsection (2),
the period of a lease -
(a) of Crown land for rural purposes,
other than for forestry, must not
exceed 21 years; and
(b) of Crown land for forestry
purposes must not exceed 10
years; and
(c) of Crown land that is not land
bordering on, or forming the bed
of, tidal or inland waters or the
sea, for industrial or business
purposes, must not exceed 50
years.

5. Section 31 amended (Lease of land for rural
purposes)
Section 31 of the Principal Act is amended by
inserting after subsection (1) the following
subsection:
(1A) Subsection (1) does not apply to a lease
of Crown land for the purpose of
forestry.
6. Section 35A amended (Compensation payable on
non-renewal of certain leases)
Section 35A of the Principal Act is amended by
inserting after subsection (4) the following
subsection:
(5) This section does not apply to a lease of
Crown land for forestry purposes.
7. Section 71A amended (Delegation)
Section 71A of the Principal Act is amended as
follows:
(a) by inserting in subsection (1) "to any
person" after "delegate";
(b) by omitting from subsection (1) "other
than" and substituting "including";
(c) by omitting subsection (2) and
substituting the following subsection:

delegated to the Secretary of a
Portfolio Department by a

8. Principal Act
In this Part, the Forest Management Act 2013* is
referred to as the Principal Act.
9. Section 3 amended (Interpretation)
Section 3 of the Principal Act is amended as
follows:
(a) by omitting the definition of future
potential production forest land;
(b) by inserting the following definition after
the definition of permanent timber
production zone land:
production forest land has the same
meaning as in the Forestry
(Rebuilding the Forest Industry)
Act 2014;
10. Section 10 amended (Reservation of Crown land as
permanent timber production zone land)
Section 10 of the Principal Act is amended as
follows:
(a) by omitting subsection (1A) and
substituting the following subsection:

boundary of any land.".
11. Section 11 amended (Revocation of permanent
timber production zone land)
Section 11 of the Principal Act is amended as
follows:
(a) by omitting from subsection (1) "land."
and substituting "land and becomes
Crown land or both Crown land and
production forest land.";
(b) by omitting subsection (8) and
substituting the following subsection:
(8) If the proposed permanent timber
production zone land revocation
order is accepted by both Houses
of Parliament, the land specified
in the order -

land; and
(b) becomes Crown land for

12. Sections 11A and 11B repealed
Sections 11A and 11B of the Principal Act are
repealed.
13. Section 12A amended (Prohibition on purchase,
&c., of production forest land)
Section 12A of the Principal Act is amended by
omitting "future potential".
14. Section 16 amended (Wood production supply)
Section 16 of the Principal Act is amended as
follows:
(a) by omitting from subsection (1)(a)
"sawlogs, from permanent timber
production zone land," and substituting
"sawlogs";

(2A) For the purposes of making
eucalypt veneer logs, eucalypt
sawlogs and other prescribed

zone land or other land, as the
Forest Manager determines.

17. Principal Act
In this Part, the Forestry (Rebuilding the Forest
Industry) Act 2014* is referred to as the
Principal Act.
18. Section 11 amended (Application for approval to
undertake special species timber harvesting in
future potential production forest land)
Section 11 of the Principal Act is amended as
follows:
(a) by omitting subsection (1) and
substituting the following subsections:
(1) This section applies in relation to
future potential production forest
land that is Crown land.
(1A) For the purposes of the operation
of this section and the Crown
Lands Act 1976 in relation to this
section -
(a) future potential
production forest land is
taken to be portfolio land
under the Crown Lands
Act 1976; and

harvesting in future potential
production forest land.

Lands Minister" first occurring and
substituting "Minister, as Portfolio

19. Principal Act
In this Part, the Forestry (Rebuilding the Forest
Industry) Act 2014* is referred to as the
Principal Act.
20. Section 3 amended (Interpretation)
Section 3 of the Principal Act is amended as
follows:
(a) by inserting the following definition after
the definition of Abt Railway Ministerial
Corporation:
ancillary harvesting activity means
any of the following activities
carried out for the purposes of
harvesting timber:
(a) providing access roads -
(i) to forestry coupes
that are permanent
timber production
zone land; or
(ii) to production
forest land that is
contained in the

the definition of forest:
forest harvesting means any
undertaking of forest practices,
within the meaning of the Forest
Practices Act 1985;

potential production forest land;
(d) by omitting the definitions of managing
entity and native forest harvesting and
substituting the following definition:

production forest land, means the
person, including the Crown, in
whom is vested the management
or ownership of that land;

prescribed production forest land
means production forest land that
is Crown land but is not also
statutory land;
production forest land means the land
referred to in section 4(1);
21. Part 2: Heading amended
Part 2 of the Principal Act is amended by
omitting "FUTURE POTENTIAL" from the
heading to that Part.
22. Section 4 amended (Production forest land)
Section 4 of the Principal Act is amended as
follows:
(a) by omitting subsection (1) and
substituting the following subsection:
(1) The following land is production
forest land:

(d) in the case of land that is
prescribed production forest land,
forest harvesting may be
undertaken on the land if
undertaken in accordance with
the Forest Practices Act 1985 and
if also permitted by a lease,
licence or other dealing under the
Crown Lands Act 1976;
(da) despite paragraph (d), the
Forestry corporation may not
undertake forest harvesting on the
land unless the area of land in
which the harvesting is

undertaken is also a forestry
coupe specified in Schedule 2;
(db) in the case of land that is
statutory land, forest harvesting
may be undertaken on the land if
undertaken in accordance with
the Forest Practices Act 1985 and
if also permitted by the managing
entity;
(dc) ancillary harvesting activities
may be undertaken on the land by
the Forestry corporation if
undertaken in accordance with
the Forest Practices Act 1985;
(d) by omitting subsection (4) and
substituting the following subsection:
(4) Paragraph (da) of subsection (2)
does not prevent the Forestry
corporation from acquiring wood
that is a product of the legal
harvesting of forest from
production forest land that is not
also a forestry coupe specified in
Schedule 2.
(e) by omitting from subsection (5) "future
potential";
(f) by omitting subsections (6), (7), (8), (9),
(10) and (11) and substituting the
following subsection:

(6) Subject to subsection (2), the
managing entity of production
forest land may perform or
exercise its functions or powers,
and discharge its obligations,
under any Act in relation to that
land.
23. Section 4A inserted
After section 4 of the Principal Act, the
following section is inserted in Part 2:
4A. Application of Crown Lands Act 1976 to
prescribed production forest land
(1) The Crown Lands Act 1976 applies in
relation to prescribed production forest
land that is Crown land.
(2) In the application of the Crown Lands
Act 1976 in relation to prescribed
production forest land -
(a) that land is portfolio land for the
purposes of that Act; and
(b) the Minister is the Portfolio
Minister for the purposes of that
Act.
(3) In exercising his or her powers as
Portfolio Minister under the Crown
Lands Act 1976 to grant a lease or
licence in relation to forest harvesting on

prescribed production forest land, the
Minister must take into account when
determining the terms and conditions of
the lease or licence -
(a) the special species management
plan; and
(b) the likely impact that forest
harvesting will have on any area
of land identified in the special
species management plan as
available for special species
harvesting.
(4) In exercising his or her powers under the
Crown Lands Act 1976, the Crown Lands
Minister may not sell, transfer or convey
an estate in fee simple in prescribed
production forest land.
(5) Subsection (4) does not apply to land
used for any of the following:
(a) electricity infrastructure;
(b) highways;
(c) powerline corridors;
(d) rail infrastructure;
(e) rail planning corridors;
(f) subsidiary roads.

34A. Former Schedule 1 land in World Heritage
List
(1) In this section -
commencement day means the day on
which this section commenced;
former Act means this Act as in force
immediately before the
commencement day;
former Schedule 1 land means land
that, immediately before the
commencement day, was
specified in column 2 of the table
set out in clause 2 of Schedule 1
of the former Act.
(2) If an area of any former Schedule 1 land
is also included in the World Heritage
List -
(a) that area of land is not production
forest land but remains vested in
the Crown unless and until the
Crown is divested of the area of
land in accordance with the
Crown Lands Act 1976 or any
other law; and
(b) forest harvesting may not be
undertaken on that area of land.

34. Principal Act
In this Part, the Nature Conservation Act 2002*
is referred to as the Principal Act.
35. Section 3 amended (Interpretation)

(b) by inserting the following definition after
the definition of private sanctuary:

PART 8 - MISCELLANEOUS
37. Further amendment, &c., of regulations not
prevented
The amendment by this Act of a provision of the
Forest Practices Regulations 2007 does not
prevent that or any other provision of those
regulations from being amended or rescinded by
a later regulation.
38. Repeal of Act
This Act is repealed on the three hundred and
sixty fifth day from the day on which all of the
provisions of this Act commence.
