FIRE SERVICE AMENDMENT BILL 2016 (Brought in by the Minister for Police, Fire and Emergency Management, the Honourable Marinus Theodoor Hidding) A BILL FOR An Act to amend the Fire Service Act 1979 Be it enacted by Her Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows: 1. Short title This Act may be cited as the Fire Service Amendment Act 2016. 2. Commencement This Act commences on the day on which this Act receives the Royal Assent. 3. Principal Act In this Act, the Fire Service Act 1979* is referred to as the Principal Act. 4. Section 7 amended (State Fire Commission) Section 7 of the Principal Act is amended as follows: *No. 35 of 1979 [Bill 62] 3

 


 

Fire Service Amendment Act 2016 Act No. of s. 5 (a) by inserting the following paragraph after paragraph (a) in subsection (3): (ab) a chairperson appointed in accordance with section 7A; and (b) by omitting subsection (5). 5. Section 7A inserted After section 7 of the Principal Act, the following section is inserted in Division 1: 7A. Chairperson of Commission (1) The Governor, on the recommendation of the Minister, is to appoint a person as chairperson of the Commission. (2) The chairperson is to be a person who the Minister considers will carry out the duties of chairperson in an independent and fair manner. (3) The chairperson holds office for the term, and on the conditions, specified in his or her instrument of appointment. 6. Repeal of Act This Act is repealed on the three hundred and sixty fifth day from the day on which it commences. 4 Government Printer, Tasmania
