LISTENING DEVICES AMENDMENT BILL 2003 (Brought in by the Minister for Justice and Industrial Relations, the Honourable Judith Louise Jackson) A BILL FOR An Act to amend the Listening Devices Act 1991 Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows: Short title 1. This Act may be cited as the Listening Devices Amendment Act 2003. Commencement 2. This Act commences on the day on which this Act receives the Royal Assent. Principal Act 3. In this Act, the Listening Devices Act 1991* is referred to as the Principal Act. *No. 21 of 1991 [Bill 99] 3

 


 

s. 4 No. Listening Devices Amendment 2003 Section 16 amended (Interpretation) 4. Section 16 of the Principal Act is amended by omitting the definition of "prescribed offence" and substituting the following definition: "prescribed offence" means - (a) an offence against a law of Tasmania which is punishable on indictment; or (b) an offence against a law of the Commonwealth, another State or a Territory which, if it were an offence against a law of Tasmania, would be punishable on indictment; or (c) an offence of a class or description prescribed for the purposes of this Part. 4 Government Printer, Tasmania
