LOCAL GOVERNMENT (KERBSIDE RECYCLING) AMENDMENT BILL 2008 (Brought in by Marinus Theodoor Hidding) A BILL FOR An Act to amend the Local Government Act 1993 to provide that, unless granted an exemption, a council must provide a kerbside recycling collection service Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows: 1. Short title This Act may be cited as the Local Government (Kerbside Recycling) Amendment Act 2008. 2. Commencement This Act commences on the day on which it receives the Royal Assent. 3. Principal Act In this Act, the Local Government Act 1993* is referred to as the Principal Act. 4. Section 20 amended (Functions and powers) Section 7 of the Principal Act is amended by inserting after subsection (5) the following subsection: (6) (a) A council must, unless granted a full or partial exemption by notice in writing by the Minister, provide a kerbside recycling collection service. (b) Where practicable, a council shall enter into an arrangement with another council in order to share the cost of providing a kerbside recycling collection service. (c) A partial exemption notice issued under subsection (6) (a) must specify the part of the municipal area where the council is exempted from providing a kerbside recycling collection service.

 


 

(d) Any notice issued under this subsection shall be published in the Gazette and is to be tabled in each House of Parliament within 10 sitting days after the day on which it is issued. ________________________________________________________________________ *No. 95 of 1993
