LAND USE PLANNING AND APPROVALS (REFORM OF FORESTRY PRACTICES) AMENDMENT BILL 2003 (Brought in by Margaret Ann Putt MHA) A BILL FOR An Act to amend the Land Use Planning and Approvals Act 1993 to remove the exemption for forestry operations. Be it enacted by His Excellency The Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows: PART 1 - PRELIMINARY Short Title 1. This Act may be cited as the Land Use Planning and Approvals (Reform of Forestry Practices) Amendment Act 2003. Commencement 2. This Act commences on the day on which it receives the Royal Assent. Principal Act 3. In this Act the Land Use Planning and Approvals Act 1993 is referred to as the Principal Act.

 


 

PART 2 - LAND USE PLANNING AND APPROVALS ACT 1993 AMENDED Section 3 amended (Interpretation) 4. Section 3 of the Principal Act is amended as follows: a) by omitting the definition of "works" and substituting the following definition: "works" includes any change to the natural or existing condition or topography of land including the removal, destruction or lopping of trees and the removal of vegetation or topsoil. b) by inserting the following definition after the definition of "development": "forestry operations" includes the processes and works connected with - (a) the establishment of forests; and (b) the growing of timber; and (c) the harvesting of timber; and (d) land clearing, land preparation, burning off, use of chemicals, road construction and associated quarry works conducted in relation to an activity specified in paragraph (a), (b) or (c). Section 20 amended 5. Section 20 of the Principal Act is amended as follows: a) By omitting subsection (1) (c) of the Principal Act and substituting the following subsection: (1) (c) may make any provision which relates to the use, development, protection or conservation of any land in the area, subject to any other provisions in this section.

 


 

b) After section 20(1)(e) of the Principal Act, the following subsection is inserted: (1)(f) must regulate forest operations within the area covered by the scheme and forest operations cannot be designated as a permitted use. c) By repealing subsection 7(a). d) By repealing subsection 7A.
