MINERAL RESOURCES DEVELOPMENT (HYDRAULIC FRACTURING) AMENDMENT BILL 2015 (Brought in by Kim Dion Booth MP) A BILL FOR An Act to amend the Mineral Resources Development Act 1995 to prohibit the use of hydraulic fracturing, also known as fracking, for the purposes of hydrocarbon resource extraction in all mineral exploration and resource project development or production processes. Be it enacted by her Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows: PART 1 - PRELIMINARY 1. Short title This Act may be cited as the Mineral Resources Development (Hydraulic Fracturing) Amendment Act 2015. 2. Commencement This Act commences on a day to be proclaimed. PART 2 - Mineral Resources Development Act 1995 AMENDED 3. Principal Act In this Act, the Mineral Resources Development Act 1995 is referred to as the Principal Act.  No. 116 of 1995. 3

 


 

4. Section 3 Amended - (Interpretation) Section 3 of the Principle Act is amendment by inserting the following new definition after the definition of "group prospecting licence": "hydraulic fracturing - means any exploration or extraction process utilizing hydraulic fracture stimulation to fracture rock with a liquid under high pressure to create artificial opening and cracks in the rock to increase permeability." 5. Section 3 Amended - (Section 3C inserted) Section 3 of the Principle Act is amended by inserting the following new Section 3C following section 3B: 3C. Prohibition on the use of hydraulic fracturing In this Act the utilization of hydraulic fracturing in all exploration activities for hydrocarbons, extraction, development and production stages of a hydrocarbon resource project is prohibited. PART 3 - REPEAL OF ACT 6. Repeal of Act This Act is repealed on the three hundred and sixty fifth day from the day on which it commences. 4
