NATIONAL TRUST PRESERVATION FUND (WINDING-UP) AMENDMENT BILL 2016 (Brought in by the Minister for Environment, Parks and Heritage, the Honourable Matthew Guy Groom) A BILL FOR An Act to amend the National Trust Preservation Fund (Winding-up) Act 1999 Be it enacted by Her Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows: 1. Short title This Act may be cited as the National Trust Preservation Fund (Winding-up) Amendment Act 2016. 2. Commencement This Act commences on the day on which this Act receives the Royal Assent. 3. Principal Act In this Act, the National Trust Preservation Fund (Winding-up) Act 1999* is referred to as the Principal Act. *No. 44 of 1999 [Bill 68] 3

 


 

National Trust Preservation Fund (Winding-up) Amendment Act 2016 Act No. of s. 4 4. Section 3 amended (Interpretation) Section 3 of the Principal Act is amended as follows: (a) by inserting the following definition after the definition of Heritage Fund: planning scheme means a planning scheme within the meaning of the Land Use Planning and Approvals Act 1993; (b) by omitting the definition of National Trust. 5. Section 5 amended (Distribution of funds) Section 5(3) of the Principal Act is amended as follows: (a) by omitting "an entry in" and substituting "places in the city of Hobart that are"; (b) by omitting paragraphs (a) and (b) and substituting the following paragraphs: (a) heritage listed under a planning scheme in effect in that city; or (b) entered in the Tasmanian Heritage Register. 4

 


 

National Trust Preservation Fund (Winding-up) Amendment Act 2016 Act No. of s. 6 6. Repeal of Act This Act is repealed on the three hundred and sixty fifth day from the day on which it commences. Government Printer, Tasmania 5
