POLICE OFFENCES (DANGEROUS KNIVES AND WEAPONS) AMENDMENT BILL 2009 (Brought in by Marinus Theodoor Hidding) A BILL FOR An Act to amend the Police Offences Act 1935 in relation to the use, possession or control of dangerous knives and weapons and for related purposes Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows: 1. Short title This Act may be cited as the Police Offices (Dangerous Knives and Weapons) Amendment Act 2009. 2. Commencement This Act commences on the day on which it receives the Royal Assent. 3. Principal Act In this Act, the Police Offences Act 1935* is referred to as the Principal Act. 4. Amendment of Principal Act - Dangerous articles Section 15C of the Principal Act is amended as follows - (1) In subsection (1) by deleting the words "in a public place" and inserting "in any place other than the person's usual place of residence"; and (2) By inserting at the end of subsection (4) the following - (7) It is a defence in proceedings under subsection (1) if the defendant establishes that, at the time of the alleged offence, the dangerous article was secure, dismantled or otherwise disabled so that it was rendered harmless.
