PENALTY UNITS AND OTHER PENALTIES AMENDMENT BILL 2011 This Public Bill originated in the House of Assembly, and, having this day passed, is now ready for presentation to the Legislative Council for its concurrence. ALCOCK, Clerk of the House 17 November 2011 (Brought in by the Minister for Justice, the Honourable Brian Neal Wightman) A BILL FOR An Act to amend the Penalty Units and Other Penalties Act 1987 Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows: 1. Short title This Act may be cited as the Penalty Units and Other Penalties Amendment Act 2011. 2. Commencement This Act commences on the day on which this Act receives the Royal Assent. Penalty Units and Other Penalties Amendment Act 2011 Act No. of s. 3 3. Principal Act In this Act, the Penalty Units and Other Penalties Act 1987* is referred to as the Principal Act. 4. Section 4A amended (Indexation of penalty units) Section 4A of the Principal Act is amended as follows: (a) by inserting the following subsection after subsection (4): (4A) An order under subsection (3) is a statutory rule. (b) by inserting the following subsection after subsection (7): (7A) Notwithstanding subsections (3) and (4) - (a) the value of a penalty unit for the financial year commencing on 1 July 2010 is taken to be and to have always been $130; and (b) the value of a penalty unit for the financial year commencing on 1 July 2011 is taken to be *No. 13 of 1987 4

 


 

Penalty Units and Other Penalties Amendment Act 2011 Act No. of s. 5 and to have always been $130. 5. Repeal of Act This Act is repealed on the ninetieth day from the day on which it commences. Government Printer, Tasmania 5
