REPEAL OF REGULATIONS POSTPONEMENT BILL (No. 2) 2011 This Public Bill originated in the House of Assembly, and, having this day passed, is now ready for presentation to the Legislative Council for its concurrence. P. R. ALCOCK, Clerk of the House 15 November 2011 (Brought in by the Minister for Workplace Relations, the Honourable David James O'Byrne) A BILL FOR An Act to postpone the repeal of the Workplace Health and Safety Regulations 1998 Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows: 1. Short title This Act may be cited as the Repeal of Regulations Postponement Act (No. 2) 2011. 2. Commencement This Act commences on the day on which this Act receives the Royal Assent. Repeal of Regulations Postponement Bill (No. 2) 2011 Act No. of s. 3 3. Postponement of repeal (1) The staged repeal of the Workplace Health and Safety Regulations 1998 that, but for this section, was to have been effected on 1 January 2012 is postponed until 1 January 2013. (2) Subsection (1) does not prevent the Workplace Health and Safety Regulations 1998 from being rescinded before 1 January 2013. (3) In this section - "staged repeal" in relation to the Workplace Health and Safety Regulations 1998 means the repeal that was to be effected by section 11 of the Subordinate Legislation Act 1992 but was postponed under the Repeal of Regulations Postponement Act 2008, the Repeal of Regulations Postponement Act (No. 2) 2009 and the Repeal of Regulations Postponement Act (No. 2) 2010. 4. Administration of Act Until provision is made in relation to this Act by order under section 4 of the Administrative Arrangements Act 1990 - (a) the administration of this Act is assigned to the Minister for Workplace Relations; and 4

 


 

Repeal of Regulations Postponement Bill (No. 2) 2011 Act No. of s. 5 (b) the department responsible to that Minister in relation to the administration of this Act is the Department of Justice. 5. Expiry This Act expires on 2 January 2013. Government Printer, Tasmania 5
