ROAD SAFETY (ALCOHOL AND DRUGS) AMENDMENT BILL 2009 (Brought in by the Minister for Police and Emergency Management, the Honourable James Glennister Cox) A BILL FOR An Act to amend the Road Safety (Alcohol and Drugs) Act 1970 Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows: 1. Short title This Act may be cited as the Road Safety (Alcohol and Drugs) Amendment Act 2009. 2. Commencement This Act commences on a day to be proclaimed. 3. Principal Act In this Act, the Road Safety (Alcohol and Drugs) Act 1970* is referred to as the Principal Act. *No. 77 of 1970 [Bill 99] 3

 


 

Road Safety (Alcohol and Drugs) Amendment Act 2009 Act No. of s. 4 4. Section 6A amended (Driving with prescribed illicit drug in blood) Section 6A of the Principal Act is amended as follows: (a) by omitting the penalty from subsection (1); (b) by omitting subsections (3) and (4). 5. Section 17 amended (Penalties for drink-driving offences, &c.) Section 17 of the Principal Act is amended as follows: (a) by omitting from subsection (1)(b) "section 4, 6 or 14(5)" and substituting "section 4, section 6, section 6A(1) or section 14(5)"; (b) by inserting in the first table in subsection (5) after Section 4 or Minimum 5 penalty units Minimum 12 12 months 14 (5) or Maximum 30 penalty months failure to units Maximum comply with a 36 months requirement made under section 10 (4) or 10A (1) the following item: 4
