STATE GRANTS COMMISSION AMENDMENT BILL 2015 This Public Bill originated in the House of Assembly, and, having this day passed, is now ready for presentation to the Legislative Council for its concurrence. DONNELLY, Clerk of the House 19 March 2015 (Brought in by the Treasurer, the Honourable Peter Carl Gutwein) A BILL FOR An Act to amend the State Grants Commission Act 1976 Be it enacted by Her Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows: 1. Short title This Act may be cited as the State Grants Commission Amendment Act 2015. 2. Commencement This Act commences on a day to be proclaimed. 3. Principal Act In this Act, the State Grants Commission Act 1976* is referred to as the Principal Act. *No. 40 of 1976 [Bill 2] 3

 


 

State Grants Commission Amendment Act 2015 Act No. of s. 4 4. Section 4 amended (Constitution, &c., of Commission) Section 4 of the Principal Act is amended as follows: (a) by omitting from subsection (1) "4 members" and substituting "3 members"; (b) by omitting paragraph (a) from subsection (1); (c) by omitting paragraph (c) from subsection (1) and substituting the following paragraph: (c) one shall be a person who the Secretary of the Department considers to have appropriate experience in business, financial or local government matters and who is nominated by the Secretary of the Department and approved by the Minister. (d) by omitting from subsection (4) "subsection (1)(a)" and substituting "subsection (1)(c)". 5. Section 5 amended (Term of office and removal of members) Section 5 of the Principal Act is amended as follows: (a) by omitting from subsection (1)(a) "3 years" and substituting "5 years"; 4

 


 

State Grants Commission Amendment Act 2015 Act No. of s. 6 (b) by omitting from subsection (2) "(being a person having experience as provided in paragraph (a) of section 4(1) or nominated as provided by paragraph (b) or paragraph (c) of that section, as the case requires)" and substituting "(being a person nominated as provided by section 4(1)(b), or nominated and approved as provided by section 4(1)(c), as the case requires)". 6. Section 6 amended (Procedure of the Commission) Section 6 of the Principal Act is amended as follows: (a) by omitting from subsection (1)(b) "4 members" and substituting "3 members"; (b) by omitting from subsection (1)(c) "questions; and" and substituting "questions."; (c) by omitting paragraph (d) from subsection (1); (d) by omitting from subsection (2)(c) "3 members" and substituting "2 members". 7. Section 7 substituted Section 7 of the Principal Act is repealed and the following section is substituted: 5

 


 

State Grants Commission Amendment Act 2015 Act No. of s. 8 7. Staff and support to be provided to the Commission The Secretary of the Department must arrange for there to be made available to the Commission - (a) the State Service officers and State Service employees employed in a State Service Agency; and (b) the financial and other support - who or that may be necessary to enable the Commission to exercise and perform the Commission's powers and functions under this Act. 8. Repeal of Act This Act is repealed on the three hundredth and sixty fifth day from the day on which it commences. 6 Government Printer, Tasmania
