STATUTORY OFFICERS (AGE FOR RETIREMENT) BILL 2005 (Brought in by the Minister for Justice and Industrial Relations, the Honourable Judith Louise Jackson) A BILL FOR An Act to amend or abolish the age for retirement for certain statutory officers Be it enacted by His Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows: 1. Short title This Act may be cited as the Statutory Officers (Age for Retirement) Act 2005. 2. Commencement This Act commences on the day on which this Act receives the Royal Assent. 3. Amendments to miscellaneous Acts The legislation specified in Schedule 1 is amended as specified in that Schedule. [Bill 6] 3

 


 

sch. 1 No. Statutory Officers (Age for Retirement) 2005 SCHEDULE 1 - AMENDMENTS TO MISCELLANEOUS ACTS Section 3 Alcohol and Drug Dependency Act 1968 1. Clause 1 of Schedule 1 is amended by omitting subclause (3) and substituting the following subclause: (3) A person is not eligible to be appointed as a member of the Tribunal if the person has vacated the office of member of the Tribunal under clause 4. Consumer Affairs Act 1988 1. Schedule 1 is amended as follows: (a) by omitting subclause (2) from clause 1; (b) by omitting paragraph (b) from clause 3(1). Coroners Act 1995 1. Section 12 is repealed. Director of Public Prosecutions Act 1973 1. Section 5(2) is amended by omitting "65" and substituting "72". 4

Schedule 2 is amended as follows: (a) by omitting subclause (3) from clause 1; (b) by omitting from clause 7(1)(h) "absence; or" and substituting "absence."; (c) by omitting paragraph (i) from clause 7(1). Gaming Control Act 1993 1. Schedule 2 is amended as follows: (a) by omitting subclause (2) from clause 1; (b) by omitting from clause 6(f) "absence; or" and substituting "absence."; (c) by omitting paragraph (g) from clause 6. Government Business Enterprises Act 1995 1. Schedule 5 is amended as follows: (a) by omitting subclause (2) from clause 2; (b) by omitting paragraph (i) from clause 8(1). 5

Section 8(2) is amended by omitting "65" and substituting "72". 2. Section 9(4)(a) is amended by omitting "65" and substituting "72". Mental Health Act 1996 1. Clause 5 of Schedule 1 is amended as follows: (a) by omitting subclause (3); (b) by omitting from subclause (4)(c) "office; or" and substituting "office -"; (c) by omitting paragraph (d) from subclause (4). Ombudsman Act 1978 1. Section 5 is amended by omitting subsection (3). Private Forests Act 1994 1. Schedule 2 is amended as follows: (a) by omitting subclause (2) from clause 1 and substituting the following subclause: 7

Veterinary Surgeons Act 1987 1. Schedule 1 is amended as follows: (a) by omitting clause 1; (b) by omitting from clause 8(1)(j) "subclause (2); or" and substituting "subclause (2)."; (c) by omitting paragraph (k) from clause 8(1). Workers Rehabilitation and Compensation Act 1988 1. Schedule 3 is amended as follows: (a) by omitting clause 2; (b) by omitting from clause 7(1)(f) "resignation;" and substituting "resignation; or"; (c) by omitting paragraph (g) from clause 7(1).
