VEHICLE AND TRAFFIC AMENDMENT (PROBATIONARY LICENCES) BILL 2017 This Public Bill originated in the House of Assembly, and, having this day passed, is now ready for presentation to the Legislative Council for its concurrence. SHANE DONNELLY, Clerk of the House 3 May 2017 (Brought in by the Minister for Infrastructure, the Honourable Marinus Theodoor Hidding) A BILL FOR An Act to amend the Vehicle and Traffic Act 1999 Be it enacted by Her Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows: 1. Short title This Act may be cited as the Vehicle and Traffic Amendment (Probationary Licences) Act 2017. 2. Commencement This Act commences on a day to be proclaimed. 3. Principal Act In this Act, the Vehicle and Traffic Act 1999* is referred to as the Principal Act. *No. 70 of 1999 [Bill 5] 3

 


 

Vehicle and Traffic Amendment (Probationary Licences) Act 2017 Act No. of s. 4 4. Section 3 amended (Interpretation) Section 3(1) of the Principal Act is amended by inserting after paragraph (a) in the definition of probationary licence the following paragraphs: (ab) to a person who applies for a driver licence in prescribed circumstances; or (ac) to a person who has completed a period of suspension, or disqualification, in prescribed circumstances; or 5. Part 3, Division 1A: Heading repealed Part 3 is amended by omitting the heading "Division 1A -- Regression and recommencement of novice drivers and novice riders". 6. Section 13A repealed Section 13A of the Principal Act is repealed. 7. Section 13B amended (Recommencement or extension of provisional period on conviction for prescribed offence) Section 13B of the Principal Act is amended as follows: (a) by omitting paragraph (a) from subsection (1) and substituting the following paragraph: 4

 


 

Vehicle and Traffic Amendment (Probationary Licences) Act 2017 Act No. of s. 8 (a) commits a prescribed offence before completing the first continuous 12-month period for which he or she is required to hold a provisional licence; and (b) by omitting subsection (2). 8. Section 18 amended (Restricted driver licences) Section 18(2) of the Principal Act is amended by omitting paragraph (ba). 9. Section 38 amended (Driver licensing scheme) Section 38(2) of the Principal Act is amended by inserting after paragraph (h) the following paragraph: (ha) may prescribe - (i) a system of case management that may apply in respect of specified novice drivers or novice riders; and (ii) the requirements with which a novice driver or novice rider may be required to comply, as determined by the Registrar, as part of case management; and (iii) that the Registrar may determine which requirements of case management apply to all participants, or a class of 5

 


 

Vehicle and Traffic Amendment (Probationary Licences) Act 2017 Act No. of s. 10 participants or an individual participant, in case management; and (iv) anything necessary, or incidental, to establish the system of case management for novice drivers or novice riders and any related practices and procedures; and 10. Section 67 amended (Evidentiary certificates) Section 67 of the Principal Act is amended by omitting subsection (6). 11. Repeal of Act This Act is repealed on the three hundred and sixty fifth day from the day on which it commences. 6 Government Printer, Tasmania
