             Amends the legislation in Schedule 1.
Clause 4     Legislation rescinded
             Rescinds the by-laws for the organisations as specified in
             Schedule 2.
Clause 5     Repeal of Act
             Repeals the Act.
SCHEDULE 1   CONSEQUENTIAL AMENDMENTS
             Education Act 1994
Clause 1     Section 3 Amended (Interpretation)
             Amends definitions as required to account for revised
             governance arrangements.


Clause 2     Amends Section 6 (Attendance)
             Amends the section to account for revised governance
             arrangements.
Clause 3     Amends Section 10 (Excused from daily attendance)
             Amends the section to account for revised governance
             arrangements.
Clause 4     Amends Section 14 (Authorised persons)
             Amends the section to account for revised governance
             arrangements.
Clause 5     Amends Section 16 (Evidence and presumptions)
             Amends the section to account for revised governance
             arrangements.

Clause 6 Amends Section 47B (Entitlement to attend Academy or Polytechnic) Amends the section to account for revised governance arrangements. Clause 7 Amends Section 47C (Attending Academy or Polytechnic after entitlement ends) Amends the section to account for revised governance arrangements. Clause 8 Amends Section 47D (Requirement that person be of good character) Amends the section to account for revised governance arrangements. Education and Training (Tasmanian Skills Institute) Act 2008 Clause 1 Amends the long title Adds "for employers" to the description of the Skills Institute function to improve clarity regarding the focus of the Skills Institute, the Academy and the Polytechnic. Clause 2 Amends Section 3 (Guiding Principle) Replaces `established' with `continued' in reference to the Tasmanian Academy and Tasmanian Polytechnic. Clause 3 Amends Section 6 (Functions of Skills Institute) Adds "for employers" to the functions of the Skills Institute as appropriate to improve clarity regarding the focus of the Skills Institute, the Academy and the Polytechnic. Clause 4 Amends Section 7 (Powers of Skills Institute) Adds "for employers" to the powers of the Skills Institute as appropriate to improve clarity regarding the focus of the Skills Institute, the Academy and the Polytechnic. State Service Act 2000 Clause 1 Amends Part 2 of Schedule 1(State authorities) Removes the Academy and the Polytechnic from the schedule of State authorities. Teachers Registration Act 2000 Clause 1 Amends Section 3 (Interpretations) To replace `establish' with `continue' in the definitions of the Academy and Polytechnic. 2 of 3

 


 

Clause 2 Amends Section 25 (Registers) Removes the Academy and Polytechnic from the definition of teacher employing authority. SCHEDULE 2 LEGISLATION RESCINDED Rescinds Tasmanian Academy and Tasmanian Polytechnic By- laws. 3 of 3
