EDUCATION AND TRAINING (TRANSITIONAL PROVISIONS) BILL 2010
CLAUSE NOTES
Clause 1 Short title
Education and Training (Transitional Provisions) Act 2010
Clause 2 Commencement
1 January 2011
Clause 3 Interpretation
Provides meanings for terms used in the Bill
Clause 4 Abolition of former Academy, former Polytechnic,
Academy Board and Polytechnic Boards
Abolishes Academy and Polytechnic from the commencement
date.
Abolishes the Academy and Polytechnic boards on a day
determined by the Minister once their obligations in clauses 11
and 12 are fulfilled.
Clause 5 Abolition of Academy audit committee and Polytechnic
audit committee
Abolishes the Academy and Polytechnic audit committees on a
day the Board is abolished.
Clause 6 Employees
Transfers all employees from the Academy and Polytechnic to
the Department of Education.
Subclause 6(3) prevents an employee from making an
application to the State Service Commissioner to review the
transfer.
Clause 7 Property
Transfers all property of the Academy and Polytechnic, real or
otherwise, as well as liabilities to the Crown.
Clause 8 Contracts
Transfers all contracts of the Polytechnic and Academy, if
appropriate, to the Crown.

Clause 9 Documents
Enables all documents issued by the Academy or the Polytechnic
to be taken to have been issued by the Crown where
appropriate.
Clause 10 Legal matters
Enables legal matters affecting the Academy and Polytechnic
prior to the transition day to be transferred to the Crown if
appropriate.
Clause 11 Financial statements of former Academy and former
Polytechnic
Requires the Boards to provide financial statements to the
Auditor General for the period 1 July to 31 December 2010.
Clause 12 Semi-annual report for former Academy and former
Polytechnic
Requires the Boards to provide semi-annual reports for the
period 1 July to 31 December 2010 to the Minister.
Clause 13 Tabling of semi-annual report
Requires the Minister to table the semi-annual report in
Parliament.
Clause 14 Regulations
Standard clause to provide for the making of regulations as
required to govern the operation of the Act.
Clause 15 Administration of Act
Allocates responsibility for the administration of the Act.
