FORESTRY AMENDMENT BILL 60 OF 2009

           Forestry Amendment Bill 2009




                  Clause Notes



Clause 1         Short title and citation.




Clause 2         The Act will commence on the day on which it receives
                 Royal Assent.




Clause 3         The Principal Act is the Forestry Act 1920.




Clause 4         Inserts a new section 4D in Part 1 of the Principal Act to
                 the effect that except as otherwise provided by
                 regulations made under the Principal Act a law of
                 Tasmania specifying a certain mass, weight or
                 dimension limit does not apply to the use of a vehicle or
                 combination on forestry roads.

 


 

CLAUSE NOTES FORESTRY AMENDMENT BILL 2009 Clause 5 To remove any doubt that forest roads can be closed to all traffic, section 26 of the Principal Act is amended as follows:- In subsection (1) omitting "vehicular traffic" from the definition of "prescribed sign" and substituting it with "all traffic or to a class of traffic". Inserting in subsection (1) a definition of "traffic" to mean pedestrian or vehicular traffic. In subsection (2) omitting "vehicular traffic" and substituting "all traffic, or to a class of traffic". In subsection (6) omitting "vehicular traffic" and substituting "all traffic, or to a class of traffic". Clause 6 The Act will be repealed on the ninetieth day from the day it commences. This Clause is a standard Clause included in Amendment Acts to avoid the need to repeal the Act by a subsequent enactment.
