FRUIT AND NUT INDUSTRY (RESEARCH, DEVELOPMENT AND EXTENSION
                    TRUST FUND) ACT 2011


                                   CLAUSE NOTES



Clause 1 ­ The short title of the Act is the Fruit and Nut Industry (Research, Development and
Extension Trust Fund) Act 2011.

Clause 2 ­ The provisions for the Act commence on the day on which the Act receives royal
assent.

Clause 3 ­ sets out the interpretations for the purposes of the Act.

Clause 4 ­ This clause states that the existing Apple and Pear Industry Research and
Development Account (APIRD) by section 5 of the Repealed Act will continue as the Fruit and
Nut Research, Development and Extension Trust Fund (FRNDE Account). The clause also
specifies the activities that can be applied by the Board of Management for use of the Trust
Funds.

Clause 5 ­ This clause defines the Board structure.

Clause 6 ­ This clause specifies the protection from liability for members of the Board.

Clause 7 ­ This clause provides for the governor to make regulations for the purposes of the
Act.

Clause 8 ­ This clause specifies that the administration of the Act is assigned to the Minister
for Primary Industries and Water.

Clause 9 ­ This clause specifies the transitional and savings provisions set out in Schedule 3
have effect.

Clause 10 ­ This clause specifies that this new Act repeals the Apple and Pear Industry (Crop
Insurance) Amendment and Repeal Act 1999.

SCHEDULE 1 ­ MEMBERSHIP OF BOARD OF MANAGEMENT

This schedule (Clause 1 to 8) specifies the membership terms of the Board of Management.

SCHEDULE 2 ­ MEETINGS OF THE BOARD OF MANAGEMENT

This schedule specifies the requirements for meeting procedure, voting and disclosure of
conflict of interest for the Board of Management.
 
 
SCHEDULE 3 ­ TRANSITIONAL AND SAVINGS PROVISIONS

This schedule specifies that the Board of Management appointed under the Repealed Act and
holding office immediately before the day on which this Act commences is taken to be
appointed as a member of the Board of Management, and makes provision for construction of
documents.

SCHEDULE 4 ­ LEGISLATION REPEALED

The Legislation that has been repealed (Apple and Pear Industry [Crop Insurance] Amendment and
Repeal Act 1999 [No. 79 of 1999]).
