LOCAL GOVERNMENT AMENDMENT (LOCAL GOVERNMENT BOARD) BILL 20 OF 2009

CLAUSE 1 -         SHORT TITLE

CLAUSE 4 -         SECTION 210 AMENDED (LOCAL GOVERNMENT BOARD)
This amendment will remove the position on the Board for `one person who has
experience in local government'. This will reduce the number of standing Board
members from five to four.
The amendment also creates two new positions for specialist members who may
be appointed by the Minister on a review-by-review basis.
CLAUSE 5 -         SECTION 213 AMENDED (DELEGATION BY BOARD)
This amendment extends, for consistency, the Board's capacity to delegate its
functions to include its reviews of single and joint authorities.
CLAUSE 6 -         SECTION 214 AMENDED (REVIEWS OF COUNCIL)
This amendment removes the mandatory requirement for the Board to carry out
general reviews of a council at least every eight years.
The Minister for Local Government retains the option to instigate council
reviews as required.
CLAUSE 7 -         SCHEDULE 1 AMENDED (MEMBERSHIP OF LOCAL
                    GOVERNMENT BOARD)
This amendment sets out the term and scope of office of the two new specialist
members positions ("review members") as differentiated from standing members
of the Board ("general members").

CLAUSE 8 - SCHEDULE 2 AMENDED (MEETINGS OF LOCAL GOVERNMENT BOARD) This amendment reduces the quorum at any meeting of the Board, from four out of five standing members to three out of four standing members. This reflects the reduction in the number of standing members from five to four. 2
