LIVING MARINE RESOURCES MANAGEMENT AMENDMENT BILL 2015 BILL 50 OF 2015

                                     CLAUSE NOTES

            Living Marine Resources Management Amendment Bill 2015

Clause 1     Short title and citation.


Clause 2    The Act commences on a day or days to be proclaimed


Clause 3    The Principal Act is the Living Marine Resources Management Act 1995.

Clause 4    Section 99C inserted
            After section 99B of the Principal Act, the following section is inserted in
            Division 7:

            99C. Fee payable under new deed of agreement
            This section reduces the fee payable under clause 5.2 of the so-called ‘new’
            abalone deed of agreement set out in Schedule 3 of the Principal Act from
            8.125% to 7%.


Clause 5    Section 210 amended (Liability of master of vessel)
            Omits “allegedly” as necessary.


Clause 6    Section 211 amended (Liability of employer)
            Omits “allegedly” as necessary.


Clause 7    Section 213 amended (Liability of holder of authorisation regarding offence by
            agent)
            Omits “allegedly” as necessary.


Clause 8    Section 213A amended (Liability of holder of licence regarding offence by
            supervisor)
            Omits “allegedly” as necessary.


Clause 9    Section 214 amended (Liability of supervisors)
            Omits “allegedly” as necessary.


Clause 10   Repeal of Act
            The Act is repealed one year from the day on which all of its provisions
            commence.
