MISUSE OF DRUGS AMENDMENT BILL 2016 BILL 1 OF 2016

                       CLAUSE NOTES

            Misuse of Drugs Amendment Bill 2016

Clause 1:   Provides that the Act is to be cited as the Misuse of Drugs
            Amendment Act 2015.

Clause 2:   Provides that the Misuse of Drugs Amendment Act 2015
            commences on the day on which it receives the Royal Assent.

Clause 3:   Provides that the Misuse of Drugs Act 2001 is the Principal Act.

Clause 4:   Inserts in Part 5 of the Principal Act a new section 38A which
            provides the Commissioner of Police with power to exempt, by
            instrument in writing, a specified person from any provision of
            the Misuse of Drugs Act 2001.

            The exemption may be granted for a specific period, not
            exceeding 3 years.

            The exemption expires either at the end of the period for which
            it has been granted, or when the exemption is revoked,
            whichever occurs first.

            The exemption may be made subject to such conditions, if any,
            as the Commissioner of Police thinks fit.

            The Commissioner of Police may vary or revoke the exemption
            or any of its conditions.

Clause 5:   Provides that this amending Act expires after one year.
