Medical Radiation Science Professionals Registration (Repeal) Bill

PART 1 Preliminary
Clause 1 Short Title
Clause 2 Commencement
This clause provides that the Act will commence on Royal Assent
other than Parts 3, 4, 5 and 6 which will instead commence on 1
July 2012. This is the date on which relevant changes under the
Health Practitioner Regulation National Law come into
operation.
PART 2 Health Practitioner Regulation National Law (Tasmania)
Act 2010 amended
Clause 3 Principal Act
This clause provides that the principal Act being amended in this
Part is the Health Practitioner Regulations National Law (Tasmania)
Act 2010.
Clause 4 Section 9 amended (Interpretation)
This clause provides that section 9 of the Principal Act is to
amend the definition of "former health practitioner registration
Act" by including the Medical Radiation Science Professionals
Registration Act 2000 in the list of former health practitioner
registration Acts.
PART 3 Health Complaints Act 1995 Amended
Clause 5 Principal Act
This clause provides that the principal Act being amended in this
Part is the Health Complaints Act 1995.
Clause 6 Section 30 amended (Withdrawal of complaint)
This clause amends section 30 of the Principal Act to correct
incorrect section references.
Clause 7 Section 36 amended (Commissioner may end
conciliation)
This clause amends section 36 of the Principal Act to correct

incorrect section references.
Clause 8 Section 40 amended (Matters that may be investigated)
This clause amends section 40 of the Principal Act to correct
incorrect section references.
Clause 9 Section 43 amended (Conduct of investigation)
This clause amends section 43 of the Principal Act to correct
incorrect section references.
Clause 10 Section 58 amended (Investigation of complaints or
grievances by a local registration board)
This clause amends section 58 of the Principal Act to correct
incorrect section references.
Clause 11 Schedule 2 repealed
This clause repeals Schedule 2 which currently lists local
registration Boards, as the Medical Radiation Science
Professionals Registration Board was the last local registration
Board and will no longer exist.
Part 4 Pharmacy Control Act 2001 Amended
Clause 12 Principal Act
This clause provides that the principal Act being amended in this
Part is the Pharmacy Control Act 2001.
Clause 13 Section 3 amended (Interpretation)
This clause provides that section 3 of the Principal Act is to be
amended by omitting the definition of "registration board" and
substituting it with a new definition providing that "registration
board" means a board established under section 31 of the Health
Practitioner Regulation National Law (Tasmania). This is because
section 3 currently also refers to the Medical Radiation Science
Professionals Registration Board which will no longer exist.
Part 5 Public Health Act 1997 Amended
Clause 14 Principal Act
This clause provides that the principal Act being amended in this
Part is the Public Health Act 1997.
Clause 15 Section 94 amended (Application of Division 3)
This clause provides that the repealed Act is omitted from

section 94 of the Principal Act. This is because activities carried
out under the Health Practitioner Regulation National Law
(Tasmania) is already captured by that section.
Part 6 Legislation Repealed and Rescinded
Clause 16 Legislation repealed
This clause provides that the legislation set out in Schedule 1 of
the Act is repealed, being the Medical Radiation Science
Professionals Registration Act 2000.
Clause 17 Legislation rescinded
This clause provides that the legislation set out in Schedule 2 of
the Act is rescinded, being regulations made under the Medical
Radiation Science Professionals Registration Act 2000.
Part 7 Repeal of Act
Clause 18 Repeal of Act
This clause provides that the amendment Act is repealed on 30
June 2013, 12 months from the day on which it substantively
commences. The repeal will not affect the operation of the
amendments made.
Schedule 1 Legislation Repealed
Schedule 1 lists the Medical Radiation Science Professionals
Registration Act 2000 (No. 65 of 2000), which is repealed by
operation of section 16.
Schedule 2 Legislation Rescinded
Schedule 2 lists the Medical Radiation Science Professionals
Regulations 2003 and the Medical Radiation Science Professionals
Registration (Fees) Regulations 2008, which are rescinded by
operation of section 17.
