PUBLIC HEALTH AMENDMENT (CERVICAL SCREENING) BILL

                     CLAUSE NOTES


Clause 1   Short Title

Clause 2   Commencement

           This clause provides for the Act to commence on
           proclamation.

Clause 3   Principal Act

           This clause provides that the principal Act amended by this
           Act is the Public Health Act 1997.

Clause 4   Section 3 amended (Interpretation)

           This clause amends the interpretation section of the
           principal Act to define a number of new terms introduced.
           They are, `corresponding register', `HPV vaccination
           information', `Medicare Australia', `National HPV
           Vaccination Program Register' and `personal information'.

Clause 5   Part 7 Division 1: Heading amended

           This clause provides that the name of the Register in
           Tasmania that records information pursuant to this Part is
           changed to the Cervical Screening Register.

Clause 6   Section 137 amended (Cervical Screening Register)

           This clause amends section 137 of the principal Act to
           reflect the change in name of the register.

Clause 7   Sections 137A and 137B inserted

           This clause provides that two new clauses are to be
           included in the principal Act.

           The proposed section 137A sets out a non exhaustive list of
           the type of information that may be recorded on the
           register.

           The proposed section 137B sets out the parties with whom,
           for relevant purposes, information contained on the

            Register may be shared.

Clause 8    Section 138 amended (Use of information on Cervical
            Screening Register)

            This clause provides a clarified list of purposes for which
            information contained on the register may be shared with
            other parties.

Clause 9    Section 139 amended (Disclosing information in Cervical
            Screening Register)

            This clause clarifies that information contained on the
            register cannot be shared with other parties unless it is
            being shared:

            ·   for a purpose set out in section 138 of the principal Act;
                or

            ·   with the consent of the person whose information is
                being shared.

Clause 10   Section 140 amended (Objection to inclusion in Cervical
            Screening Register)

            This clause amends section 140 of the principal Act to
            reflect the change in name of the register.

Clause 11   Section 142 amended (Removal of identifying data from
            Cervical Screening Register)

            This clause amends section 142 of the principal Act to
            reflect the change in name of the register.

Clause 12   Schedule 3 amended (Savings and transitional)

            This clause amends Schedule 3 of the principal Act to
            reflect the change in name of the register.
