RESIDENTIAL TENANCY AMENDMENT BILL 2015 BILL 7 OF 2015

                         CLAUSE NOTES

            Residential Tenancy Amendment Bill 2015

Clause 1:    cites the name (short title of the Act)
Clause 2:    provides for the Act to be commenced upon receiving Royal
             Assent.
Clause 3:    identifies that for the purposes of Part 2 of this Act (sections 3,4
             and 5), the Principal Act is the Residential Tenancy Act 1997.
Clause 4:     returns section 39 to the pre Residential Tenancy Amendment Act
              2013 provisions in regards to a tenant issuing a notice to
              terminate.
Clause 5:     extends the operation of section 57 of the Principal Act to
              include situations where a Police Family Violence Order is in
              force.
Clause 6:     identifies that for the purposes of Part 3 of this Act (sections 6, 7
              and 8), the Principal Act is the Residential Tenancy Amendment
              Act 2013.
Clause 7:     provides flexibility with regard to “heating elements” to require a
              premise with three or more bedrooms to have at least three
              cooking elements, and all smaller premises to have at least two
              cooking elements.
Clause 8:     reduces the scope of section 26 to only applying to photographs,
              film or video recordings that identify the tenant or another
              person.
Clause 9:     provides that this amendment act is automatically repealed a
              year from commencement.
