SENTENCING AMENDMENT (RACIAL MOTIVATION) BILL 2016 BILL 64 OF 2016

                                CLAUSE NOTES

            Sentencing Amendment (Racial Motivation) Bill 2016

Clause 1:      Short title of the Bill.

Clause 2:      The Act commences on Royal Assent.

Clause 3:      Principal Act is the Sentencing Act 1997.

Clause 4:      Inserts Section 11B (Racial motivation to be taken into account in
               sentencing offenders) by providing that when determining an offender’s
               sentence, the court is to take into account as an aggravating
               circumstance whether the offence was motivated by racial hatred or
               prejudice either in relation to:

                       a) a victim of the offence; or

                       b) a person or group of persons whom the victim was, or
                          believed to be, associated at the time of the offence.

Clause 5:      Provides that this Act is repealed a year after it commences.
