CLAUSE NOTES - TRAFFIC AMENDMENT (ROAD RULES CONSEQUENTIAL AMENDMENTS) BILL 2009




    Traffic Amendment (Road Rules
  Consequential Amendments) Bill 2009



                             Clause Notes


Clause 1         Short title and citation

Clause 2         The Act will commence on the day it receives Royal
                 Assent.

Clause 3         In Part 2, of this Act the Principal Act is the Local
                 Government (Highways) Act 1982.

Clause 4         Amends section 44(3) of the Local Government
                 (Highways) Act 1982 by omitting the reference to "rule
                 103 of the Traffic (Road Rules) Regulations 1999" and
                 replacing it with a reference to "rule 103 of the Road
                 Rules". By using the short title "Road Rule" it will not
                 be necessary to change the legislative reference each
                 time the "Road Rules" are remade.

Clause 5         In Part 3, of this Act the Principal Act is the Motor
                 Accidents (Liabilities and Compensation) Act 1973.

Clause 6         Amends section 22(3)(b)(i) of the Motor Accidents
                 (Liabilities and Compensation) Act 1973 by omitting
                 "Traffic (Road Rules) Regulations 1999" and replacing
                 it with "Road Rules" for the reasons previously
                 explained.

Clause 7         In Part 4, of this Act the Principal Act is the Taxi and
                 Luxury Hire Car Industries Act 2008.

Clause 8         Amends section 3 of the Taxi and Luxury Hire Car
                 Industries Act 2008 by omitting Traffic (Road Rules)
                 Regulations 1999 from the definition of "taxi zone sign"
                 and substituting "Road Rules" for the reasons previously

 


 

CLAUSE NOTES - TRAFFIC AMENDMENT (ROAD RULES CONSEQUENTIAL AMENDMENTS) BILL 2009 explained Clause 9 This Clause is a standard provision to be included in all Amendment Bills, the effect of which is to automatically repeal the Amendment Act after 90 days from the date of its commencement. This will make it unnecessary for the Government to periodically introduce a Legislation Repeal Act to repeal Amendment Acts, as once the amendments are incorporated into the Principal Act the Amendment Act no longer serves any practical purpose.
