VEHICLE AND TRAFFIC AND RELATED LEGISLATION
   (MISCELLANEOUS AMENDMENTS) BILL 2010


                           CLAUSE NOTES




PART 1




Clause 1   Short title and citation.




Clause 2   The Act will commence upon Royal Assent.

 


 

PART 2 Clause 3 In Part 2 of this Act the Principal Act referred to is the Road Safety (Alcohol and Drugs) Act 1970. Clause 4 Amends section 2 of the Principal Act as follows; (a) by inserting a definition of the term `GVM' as defined in the Vehicle and Traffic Act 1999 and; (b) by omitting from subsection (2A)(c) the words gross vehicle mass which is not defined in the Principal Act and substituting `GVM' consequential to the amendment under paragraph (a).

 


 

PART 3 Clause 5 In Part 3 of this Act the Principal Act is the Vehicle and Traffic Act 1999. Clause 6 Amends Section 3 (1) of the Principal Act by; (a) Amending the definition of `GCM' to explain the meaning of that term. (b) Amending the definition of `GVM' to explain the meaning of that term. (c) Insert a definition of `Personalised Number Plate' to provide for a plate issued by the Registrar to contain a specific registration number or a plate that does not meet the specifications of standard number plates issued under the Act.

 


 

(d) Inserting a definition of `Specific Registration Number' to mean a combination of letters and numbers that can be requested as the registration number to be displayed on the number plate. Clause 7 Amends Section 13A of the Principal Act by omitting "section 20" and substituting "section 24" to correct an incorrect cross reference. Clause 8 Inserts a new section 39A in Part 6 of the Principal Act to provide for the making of regulations with respect to the sale, use and rights with respect to personalised number plates that may be attached to or held independently of a vehicle. The regulations to be made under this provision may provide for the validation of any prescribed actions taken before the commencement of this Act.

 


 

PART 4 Clause 9 This clause is a standard provision agreed to be included in Amendment Bills, the effect of which is to automatically repeal the Act after 90 days from the date of the commencement of all of the provisions of the Act. This will make it unnecessary for the Government to later repeal the Act by a Legislation Repeal Act. Once the amendments are incorporated into the Principal Acts the Amendment Act serves no practical purpose and can be safely repealed.
