REPEAL OF REGULATIONS POSTPONEMENT BILL 25 OF 2011

                                             FACT SHEET 

                       The Repeal of Regulations Postponement Bill 2011 

 
The  Subordinate  Legislation  Act  1992  provides  for  the  systematic  repeal  of  subordinate 
legislation over a rolling 10year  period. If Regulations are to continue to have effect they 
must be remade in accordance with the requirements of the Act.  
 
Each year for a variety of reasons the Government needs to defer the repeal of a number of 
regulations that fall due for automatic repeal under the Subordinate Legislation Act 1992.  
 
This  Bill  will  postpone  until  1  July  2013  the  automatic  repeal  of  the  Vehicle  and  Traffic 
(Vehicle  Operations)  Regulations  2001  and  the  Vehicle  and  Traffic  (Vehicle  Standards) 
Regulations 2001 which are due to expire during the next twelve (12) months to ensure that 
they can continue in operation past those dates.  
 
Deferring  the  automatic  repeal  of  the  regulations  when  necessary  is  essential  for  the 
effective operation of government and administration of legislation. The making of interim 
regulations to take effect between the automatic repeal of one set of regulations and the 
commencement of new regulations often under revised or new Acts can be an unnecessary 
waste of resources.
