(1) The Board, at the request of a complainant or the Australian legal practitioner in relation to whom a complaint is made, must provide the complainant or practitioner with (a) full details of (i) the person or persons conducting the investigation; and(ii) the progress of the investigation into the matter; and(iii) the documents being examined; and(b) copies of any documents relating to the investigation.(2) The Board is not required to provide the details or copies of documents referred to in subsection (1) (a) if the provision of the details or documents will or is likely to (i) prejudice the investigation of the complaint; or(ii) prejudice an investigation by the police or other investigatory or law enforcement body of any matter with which the complaint is concerned; or(iii) place the safety of the Australian legal practitioner or another person at risk of intimidation or harassment; or(iv) prejudice pending court proceedings; or(b) if the Board has previously provided the details or documents to the complainant or the Australian legal practitioner and there has been no material change to the details of the complaint; or(c) if the Board considers that the details or documents should not be provided in order to protect the Board's legal professional privilege.
