Division 2 - Compensation for lodging caveat without sufficient cause Compensation for lodging caveat without sufficient cause

(1)  A person who lodges a caveat under this Act with the Recorder without reasonable cause shall be liable to any person who may have sustained damage as a result of the caveat being lodged for such compensation as a judge, on a summons in chambers, deems just.
(2)  The costs of a summons referred to in subsection (1) and all proceedings in connection with the summons shall be in the discretion of the judge, and execution may issue for the amount of compensation, if any, and of costs ordered by the judge to be paid in such and the like manner as if the amount had been awarded in a judgment in an action in the Supreme Court.
