(1)  The Recorder may, whenever any question arises with regard to the performance of any of the duties or the exercise of any of the functions by this or any other Act conferred or imposed upon the Recorder, state a case for the opinion of the Supreme Court.

(2)  Where a case has been stated for the opinion of the Supreme Court in accordance with subsection (1) , the Supreme Court may give judgment on the case, and that judgment is binding on the Recorder.
