LAND TITLES ACT 1980 - SECT 62
Dealings with lands of the Crown under Act
(1) A transfer under the hand of the Minister administering the
Crown Lands Act 1976 of any land of which Her Majesty is registered
proprietor, witnessed by the Director-General of Lands or an officer of the
department of the Director-General of Lands, and duly registered, has the
effect, for all purposes, of letters patent issued under the seal of the State
and duly enrolled of record.
(2) The Recorder shall not record on a folio of the Register a notice of
statutory duties or restrictions affecting lands of which Her Majesty is
registered proprietor, and no reference in the Register to a notification in
the Gazette shall be deemed to be notice of any subsisting statutory duty or
restriction.
(3) Except where the contrary is expressly enacted, no statutory duty or
restriction referred to in subsection (2) has, as against any registered
estate or interest, any greater effect than if it were enforceable only in
equity and not at law.
