When the payment of any money secured by a mortgage or encumbrance has been in arrears for 21 days, and 7 days have elapsed since demand was made for payment, the mortgagee or encumbrancee may distrain on the goods and chattels on the mortgaged or encumbered land, and Part V of the Landlord and Tenant Act 1935 applies as if the mortgagee or encumbrancee were a landlord and the mortgagor or encumbrancer were the mortagees or encumbrancees tenant.
