MINERAL RESOURCES DEVELOPMENT ACT 1995 - SECT 106
Lease for storage and other purposes
(1) A lessee or former lessee may, in an approved form, apply to the
Minister for a lease in relation to land
(a) to store any building, machinery, mining product or other property on the
land; or
(b) to enable the land to be used to enable the applicant to access land to
which a lease relates; or
(c) to enable work associated with mining on other land to be carried out; or
(d) to enable the rehabilitation of the land, where the land has been affected
by mining operations on the other land.

(3) The Minister may
(a) grant the application with or without conditions and subject to any rent
the Minister determines; or
(b) refuse to grant the application.
(4) The Minister may cancel a lease if the lessee fails to comply with,
or contravenes, any condition of the lease.
(5) A person to whom a lease is granted under this section may also
apply for a lease under section 70 .
(6) A lease issued under this section ceases to have effect on the
granting of a lease under section 78 in respect of all or part of the land to
which the lease under this section relates.
