(1) The Minister may (a) grant an application for the renewal of a lease, with or without conditions; or(b) refuse to grant the application.(2) The Minister must grant the application if satisfied that (a) the lessee has submitted a mining plan for the renewal period; and(b) the lessee has complied with the conditions of the lease and the provisions of this Act; and(c) a failure to comply with any condition of a lease was exempted under section 86 ; and(d) the lessee has provided a security deposit.(3) The Director, by notice in writing, must notify the applicant of (a) the grant of the application; or(b) the refusal to grant the application and the reasons for the refusal.(4) A lessee may appeal to the Mining Tribunal against the Minister's refusal to grant the application within 28 days after receipt of a notice under subsection (3)(b).
