MARINE AND SAFETY AUTHORITY AMENDMENT ACT 2006 (NO. 8 OF 2006) - SECT 4

Section 3 amended (Interpretation)

Section 3 of the Principal Act is amended as follows:
(a) by inserting the following definition after the definition of Board :
certificate of survey means a certificate of survey issued by the Authority or by an equivalent body, whether in this State or not, that warrants that a vessel complies with –
(a) the vessel survey requirements of the Marine and Safety (Vessel Safety Standards) By-laws 2000 made by the Authority under section 42 ; or
(b) any equivalent legislation;
(b) by inserting the following definitions after the definition of commencement day :
commercial purpose , in relation to the operation of a vessel, means operating the vessel (other than as a punt) –
(a) for any valuable consideration; or
(b) as, or in connection with, a business; or
(c) as, or in connection with, a transport or ferry service provided for the benefit of paying or non-paying passengers; or
(d) for research; or
(e) in connection with tourist accommodation; or
(f) in connection with any other kind of commercial transaction;
commercial vessel means a vessel that is operated for a commercial purpose;
(c) by inserting the following definition after the definition of transfer day :
unseaworthy means unseaworthy within the meaning of section 38B(1) ;
