LAND (REVOCATION OF RESERVATIONS) BILL 2005

         Land (Revocation of Reservations) Bill

               EXPLANATORY MEMORANDUM


                                   General
The Bill is to revoke the reservation over part of land at Richmond and to
revoke the related Crown grant over the same part of land. It also revokes the
reservation over certain land in the Parish of Sandhurst near Bendigo and
temporarily re-reserves that land.

                                Clause Notes
Clause 1    sets out the purpose of the Bill.

Clause 2    provides for commencement of the Bill on the day after the day
            Royal Assent is given.

Clause 3    revokes the Order in Council specified in Schedule 1 reserving
            land at Richmond Park, but only to the extent that the Order
            applies to the part of that land shown hatched on the plan in
            Schedule 2 (the relevant land). Clause 3 also revokes Crown
            grant Volume 1902 Folio 326 to the extent that it applies to the
            relevant land.

Clause 4    revokes the Order in Council specified in item 2 of Schedule 1
            that reserved land in the Parish of Sandhurst, near Bendigo, as a
            site for abattoirs.

Clause 5    provides that, on the revocation of the reservation referred to in
            clause 4, the land is deemed to be temporarily reserved for public
            purposes (nature conservation) under section 4(1) of the Crown
            Land (Reserves) Act 1978.

Clause 6    provides that when the reservation and Crown grant are revoked
            by clause 3 and the reservation is revoked by clause 4, the land
            (subject, in the case of the Sandhurst land, to clause 5) is deemed
            to be unencumbered unalienated Crown land, the appointment of
            any committee of management of the land is revoked and any
            applicable regulations under the Crown Land (Reserves) Act
            1978 are revoked.

Clause 7 obliges the Registrar of Titles to make any recordings in or amendments to the Register under the Transfer of Land Act 1958 necessitated by the operation of this Bill. Schedule 1 provides details about the reserved land referred to in the Bill. Schedule 2 contains a plan showing as a hatched area the land in respect of which the Order in Council referred to in clause 3 is revoked. 2
