Sustainable Forests (Timber) (Amendment) Bill Introduction Print EXPLANATORY MEMORANDUM Clause Notes Clause 1 sets out the purpose of the Bill which is to amend the Sustainable Forests (Timber) Act 2004 so that timber harvesting licences in the west of the State do not transfer to VicForests for management. Clause 2 provides for the commencement of the Bill on the day after the Bill receives Royal Assent. Clause 3 repeals section 2(3) of the Sustainable Forests (Timber) Act 2004 which provides for the commencement of those provisions of the Act providing for the transfer of timber harvesting licences in the west of the State to VicForests. With the repeal of these provisions under clause 5 of the Bill, this commencement provision no longer serves a purpose. This clause also consequentially amends section 2(5) of the Sustainable Forests (Timber) Act 2004 to remove the reference to section 2(3). Clause 4 amends the definition of "managed licence" to omit the reference to timber harvesting licences in the west of the State. This clause also repeals the definition of "transferred licence (west)" which is redundant. Clause 5 repeals the substantive provisions of the Sustainable Forests (Timber) Act 2004 that provide for the transfer of timber harvesting licences in the west of the State to VicForests, including Division 2 of Part 4, section 35(3), section 95(2) and Schedule 2. With the repeal of these provisions, timber harvesting licences in the west of the State will continue to be managed by the Secretary of the Department of Sustainability and Environment until their expiry. 1 551394 BILL LA INTRODUCTION 28/2/2006
Clause 6 repeals the Forests (Dunstan Agreement) Act 1987, which is redundant. This clause also repeals section 38 of the National Parks (Otways and Other Amendments) Act 2005. That section provides for the removal of five timber harvesting licences from Schedule 2 to the Sustainable Forests (Timber) Act 2004 by 31 December 2008. With the repeal of Schedule 2 to the Sustainable Forests (Timber) Act 2004 by clause 5 of the Bill, that section is now redundant. 2
