ADMINISTRATION AND PROBATE ACT 1958 - SECT 70P

Partner may make partner's property election to acquire intestate's interest in property of estate

    (1)     By making a partner's property election, an intestate's partner may elect to acquire property from the intestate's estate

        (a)     at its value on the date of the intestate's death as determined in accordance with section 70V; or

        (b)     at any other value as agreed by the partner and all the other beneficiaries entitled to share in the intestate's estate.

    (2)     A partner may acquire an interest by making a partner's property election even if the partner is—

        (a)     a personal representative or trustee; or

        (b)     a minor.
