BAIL ACT 1977 - SECT 16B

Capacity of child to give bail undertaking

If, in the opinion of a bail decision maker granting bail to a child, the child does not have the capacity or understanding to give a bail undertaking, the child may be released on bail if the child's parent or some other person gives an undertaking, in any amount which the bail decision maker thinks fit, to produce the child at the venue of the court to which the hearing of the charge is adjourned or the court to which the child is committed for trial.
