CRIMES (MENTAL IMPAIRMENT AND UNFITNESS TO BE TRIED) ACT 1997 - SECT 23

Effect of finding of not guilty because of mental impairment

If a person is found not guilty because of mental impairment, the court must—

S. 23(a) amended by No. 68/2009 s. 97(Sch. item 39.21).

        (a)     declare that the person is liable to supervision under Part 5; or

S. 23(b) amended by No. 68/2009 s. 97(Sch. item 39.21).

        (b)     order the person to be released unconditionally [3] .
