CRIMES (MENTAL IMPAIRMENT AND UNFITNESS TO BE TRIED) ACT 1997 - SECT 52

What are the surrounds?

S. 52(1) amended by Nos 29/2010 s. 30(1), 26/2014 s. 442(1), 19/2019 s. 245(1).

    (1)     The "surrounds", in relation to a designated mental health service or a residential treatment facility, is the area declared under subsection (2) to be the surrounds in relation to that service.

    (2)     The Governor-in-Council, by notice published in the Government Gazette, may declare an area surrounding or adjacent to a designated mental health service or a residential treatment facility to be the surrounds in relation to that designated mental health service or residential treatment facility.
