CRIMINAL PROCEDURE ACT 2009 - SECT 420ZI

Time of alleged offence or commencement of criminal proceeding does not matter

The court may make an order under section 420E in respect of a charge in an indictment irrespective of—

        (a)     when the offence charged is alleged to have been committed; and

        (b)     when the criminal proceeding to which the indictment relates was commenced.
