HERITAGE ACT 2017 - SECT 89

Offences in relation to performing certain activities

    (1)     A person must not remove, relocate or demolish, damage or despoil, develop or alter, or excavate, all or any part of a registered place.

Penalty:     In the case of a natural person, 48 penalty units;

    In the case of a body corporate, 240 penalty units.

    (2)     A person must not remove, relocate or demolish, damage or despoil, or alter, a registered object.

Penalty:     In the case of a natural person, 48 penalty units;

    In the case of a body corporate, 240 penalty units.

    (3)     A person must not disturb the position of an object that is a fixed registered object.

Penalty:     In the case of a natural person, 48 penalty units;

    In the case of a body corporate, 240 penalty units.

    (4)     Subsections (1), (2) and (3) do not apply to works or activities—

        (a)     carried out in accordance with a permit issued under Part 4 or this Part; or

        (b)     carried out in accordance with section 90; or

        (c)     carried out in accordance with section 91; or

        (ca)     that are specified in a show cause notice and which are carried out consistently with the show cause notice; or

S. 89(4)(cb) inserted by No. 5/2023 s. 59(b).

        (cb)     carried out in accordance with a repair order; or

S. 89(4)(cc) inserted by No. 5/2023 s. 59(b).

        (cc)     carried out in accordance with a rectification order; or

        (d)     for which the Heritage Council or the Executive Director has determined that a permit is not required under this Part.
